OBJECT OF THE CONTRACT:
“Online” purchase agreement refers to a distance contract, that is to say the legal transaction concerning goods and/or services between a supplier and a customer and/or client as part of a system of distance sales organised by the supplier who, for such contract, employs the technology of distance communication denominated “internet”. All contracts, therefore, shall be concluded through direct access to the website corresponding to https://www.gagamilano.com/it by the customer and/or client who, following the procedure, will conclude the contract for the purchase of the good.
The products purchased on https://www.gagamilano.com/it are sold directly by GaGà Milano (“the Seller”), fiscal code 04816810966. 1. OUR TRADE POLICY
1.1 These General Conditions of Sale exclusively regulate the offer, the transmission and the acceptance of orders for products available at https://www.gagamilano.com/it between the users of https://www.gagamilano.com/it. 1.2 The General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller that are present on https://www.gagamilano.com/it through links, banners or other hypertext links. We advise you, before placing any orders and purchasing products and services from parties other than the Seller, to verify their conditions of sale, as the Seller shall not be deemed responsible for the provision of services by third parties other than the Seller or the conclusion of commercial transactions between users of https://www.gagamilano.com/it and third parties.
2. HOW TO CONCLUDE THE CONTRACT WITH THE SELLER
2.1 To conclude the purchase of one or more products on https://www.gagamilano.com/it, you must fill out the order form and send it electronically to the Seller, via computer, following the relevant instructions. 2.2 The order form contains a link to the General Conditions of Sale and to the information on the Right to Withdraw, a summary of the information on the essential characteristics of each product ordered and its price (including taxes and excluding customs charges, responsibility of the client), the means of payment that you may use to purchase each product and the method of delivery of the products purchased, the cost of shipping and delivery, the conditions for exercising your right to Withdraw and the method and timing for the return of the products purchased. 2.3 The contract is concluded when the Seller receives, via computer, your order form, after verifying the correctness of the data related to your order. 2.4 Before purchasing the goods by transmitting the order form, you will be asked to carefully read the General Conditions of Sale and Right to Return, to print or reproduce a copy for your personal use. 2.5 The order form will be filed in our database for the period of time necessary to process your order and within the time-frame provided by the law. 2.6 Before submitting the order form, you will be asked to identify and correct any errors in the data entry. 2.7 The language available to conclude the contract with the Seller is Italian. 2.8 After the contract is concluded, the Seller will take in charge your order. 2.9 The Seller may not process your orders if you do not give sufficient guarantees of solvency or which are incomplete or incorrect, or in the event of product unavailability. In such cases we will inform you by e-mail that the contract has not been concluded and that the Seller has not carried out your order, specifying the reasons. If the products are no longer available at the time of your last access to the website or at the time you sent the order form, the Seller shall inform you promptly and in any event within ten (10) days from the day following the one when you submitted your order, of the unavailability of the products ordered. In case the order form has been sent and the price has been paid, the Seller will refund you of the sum you have already paid. 2.10 By transmitting the order form, you unconditionally accept and undertake to observe in your relationship with the Seller, these General Conditions of Sale. If you do not agree with any of the terms in the General Conditions of Sale, please do not submit your order form for the purchase of products on https://www.gagamilano.com/it. 2.11 By transmitting the order form you expressly declare to be of age, to know and accept the General Conditions of Sale and the additional information contained in https://www.gagamilano.com/it, through links as well, including the Privacy Policy and Information on the Right to Withdraw. 2.12 Once the contract is concluded, the Seller will send you, by email, a summary of the order, containing the information already provided in the order form (billing and shipping addresses, product/s purchased, their price, mode of payment).
3. GUARANTEES AND INDICATION OF THE PRICES OF THE PRODUCTS
3.1 The Seller does not sell goods that are used, irregular or of lower quality than the corresponding market standards. 3.2 The essential characteristics of the products are shown on https://www.gagamilano.com/it on each product page. The images and colours of the products offered for sale on https://www.gagamilano.com/it may not correspond exactly to the real ones due to the Internet browser or monitor used. 3.3 The prices of products may be subject to change. Make sure of the final sale price before submitting the order form. 3.4 Requests of purchase from countries not included among those displayed in the list in the order form will not be accepted by the Seller. 3.5 The Seller, in case of you exercising your Right to Withdraw, has the right to not accept the return of products that have been altered from their original status or have been damaged.
4. PAYMENTS
4.1 For the payment of products and their shipping costs you can follow one of the procedures indicated on the order form. 4.2 In case of payment by credit card, financial information (e.g. the credit card/debit card number or expiration date) will be sent by encrypted protocol to PayPal or other banks, which provide the relevant distance electronic payment services, without third parties gaining any access. Such information will not be used by the Seller except for procedures relevant to your purchase or to issue refunds in case of return of the products, as a result of exercise of your Right to Withdraw, or if it were necessary to prevent or report to the police the commission of fraud on https://www.gagamilano.com/it. The price for the purchase of products and shipping costs, as indicated in the order form, shall be charged at the time the order has been completed.
5. SHIPPING AND DELIVERY OF THE PRODUCTS
The shipment, unless indicated otherwise, shall express via Express Courier in 24/48 hours (working days) from receipt of payment. The delivery on the Islands may take one day longer. Once the package has been shipped you will receive an e-mail of confirmation indicating the courier used and the tracking number so you can track your shipment directly on the courier website.
5.2 SHIPPING AND DELIVERY OF THE PERSONALIZED PRODUCTS
The shipment and the delivery of the watches designed and personalized through the use of GaGà Milano’s configurator may take 15 working days. Once the package has been shipped you will receive an e-mail of confirmation indicating the courier used and the tracking number so you can track your shipment directly on the courier website.

7. RIGHT TO WITHDRAW
7.1 You have the right to withdraw from the contract concluded with the Seller, without penalty and without specifying the reason, within fourteen (14) days from the day of receipt of the goods purchased at https://www.gagamilano.com/it. However, it is not possible to change a product purchased with another. 7.2 To withdraw from the contract you must return the products to the Seller within fourteen (14) working days from the day you received the goods. 7.3 The costs that you will incur are those of returning the products purchased, the expenses related to the shipping company used .Custom clearance costs to re- import the goods to Italy will be deducted by the refund. 7.4 The right to withdraw – besides in compliance with the terms and conditions described in paragraphs 7.1, 7.2 and 7.3 – is properly exercised if carried out meeting the following conditions: -) The products should not have been used, washed or damaged; -) The products must be returned in their original packaging; -) The items returned must be shipped within fourteen (14) days from the date you received the products. 7.5 If the right to withdraw is exercised in conformity with the procedures and time limits specified in this paragraph 7, the Seller shall refund the amount received for the purchase of the products. 7.6 The money shall be reimbursed by the Seller in the shortest time possible and, in any case, within 14 (fourteen) days from the date on which the Seller has been informed of the decision to withdraw from the contract. 7.7 If you do not comply with the procedures and terms for the exercise of your right to withdraw, as specified in this paragraph 7, you will not be entitled to a refund of the money paid to the Seller. However, you may get back at your expense the products in the state in which they were returned to the Seller. Otherwise, the Seller shall keep the products in addition to the sum paid for their purchase.
7.8 Please note that the customized products can’t be returned or replaced with other items.
8. TIMES AND METHODS OF REPAYMENT
8.1 The refund shall be carried out by the Seller as soon as possible, and no later than fourteen (14) days from the date the goods are received back by the Seller. The Seller shall refund using the same payment method used for the initial transaction, unless notified otherwise. 8.2 If there is no correspondence between the recipient of the goods specified in the order form and whoever made the payment of the sum due for the purchase, in the event of exercise of the right to withdraw, the reimbursement shall be made by the Seller, in any case, on the account of those who made the payment. 8.3 In the event of exercise of the right to withdraw the shipping costs, including liability in case of loss or damage of the products, will be your responsibility.

10. APPLICABLE LAW AND SETTLEMENT OF DISPUTES
10.1 The General Conditions of Sale are governed by Italian law and in particular by Legislative Decree No 206, of 6 September 2005, relative to the consumer index, with specific reference to the legislation regarding distance contracts and by Legislative Decree No 70, of 9 April 2003, regarding certain aspects of electronic commerce. 10.2 The customer and GaGà Milano mutually agree to submit exclusively to the jurisdiction of the Court of Milan.
11. MODIFICATION AND UPDATE
The General Conditions of Sale may be amended from time to time in consideration of possible regulatory changes. The new General Conditions of Sale shall be effective from the date of publication on https://www.gagamilano.com/it.
